  1. General
    1. These terms of use constitute a binding legal agreement, whose provision shall apply to any use of and/or purchase on the website “visit-tlv.co.il" of the non-profit association (amuta) “Tel Aviv Global and Tourist", non-profit association No. 580019305 (hereinafter: “the Website" and “Tel Aviv Global", respectively), made by the user.
    2. Every user of the Website must read these terms of use fully and carefully.
    3. It should be emphasized that a person using the Website shall be treated as a person who has read and accepted the provisions hereof.
    4. The section headings herein are for convenience sake only.
    5. For the avoidance of any doubt, nothing herein constitutes an agreement for the benefit of any third party.
    6. The Website: www.visit-tlv.co.il is an Israeli website on the internet.
    7. Therefore, if any person does not accept any of the terms of use of the Website, he is requested not to use it in any way.
    8. Use of the Website is subject to adherence to the provisions of these terms of use.
    9. The liability of Tel Aviv Global is limited as set out herein.
    10. Tel Aviv Global shall not be liable for the acts of third parties.
    11. The intellectual rights of Tel Aviv Global, as specified below, may not be infringed.
    12. Any person who possesses a valid credit card in his name may use the Website's services which are offered for payment. No order may be placed and no registration may be made without providing the details of a credit card or any other means of payment approved by Tel Aviv Global.
    13. For the avoidance of any doubt, no purchases may be made on the Website by means of cash, checks, gift cards, gift vouchers, credits or coupons, except such that are approved by Tel Aviv Global from time to time; in addition, gift cards shall be available for purchase via the Website.
    14. In these terms of use, words and expressions importing the masculine gender shall include the feminine gender.
  2. Consent to retainment and use of information
    1. In making a purchase on the Website, the user shall be requested to enter the details of a credit card or other means of payment approved by Tel Aviv Global. Tel Aviv Global shall use this information only for the purposes of the purchases you make on the Website, and not for any other purpose or matter.
    2. Tel Aviv Global collects and retains certain types of information on the user; such information shall include, inter alia, interactions within the content and services offered on the Website. Like many other websites, Tel Aviv Global uses 'cookies' and other means, and receives various types of information.
    3. The user has the right to request that Tel Aviv Global delete or amend the information collected by it; the user has the right to be allowed access to such information; the user has the right to request that Tel Aviv Global transfer the collected information to a third party.
    4. When the user makes a purchase on the Website, he shall be requested to enter the details of his credit card and/or other means of payment approved by Tel Aviv Global; Tel Aviv Global shall use such information only for the purpose of the purchases made on the Website, and not for any other purpose.
    5. Such information shall be retained by Tel Aviv Global and/or any other person acting on its behalf, and be used in accordance with the user's consent below, and in accordance with any law and the Protection of Privacy Law, 5741-1981 (hereinafter: “the Protection of Privacy Law") and the regulations promulgated thereunder.
  3. Use of the Website
    1. The user may only use the contents of the Website in accordance with the terms and conditions set out herein.
    2. The contents of the Website may not be used in any manner other than that stipulated in the terms of use, without Tel Aviv Global's prior written consent, and subject to the conditions for such consent (if any is given).
    3. The user may use the Website for private and personal purposes only, the contents of the Website may not otherwise be copied and/or used, and the user shall not allow any other person to do so.
    4. The Website shall not be used commercially, whether by way of sending advertisements and/or any other way, without Tel Aviv Global's prior written consent, in accordance with its conditions as it may impose and at its sole discretion.
    5. If any advertisements are published on the Website, Tel Aviv Global shall not be liable or responsible for the content thereof and/or for any (direct or indirect) damage or loss that may be caused as a result.
    6. No computer application or other means, including software of any kind, may be operated for searching, scanning, copying or automatically retrieving any contents of the Website, and the user shall not allow any other person to do so. The foregoing includes creating or using such means in order to create any compilation, collection or database containing content from Tel Aviv Global.
    7. Each time the user browses and/or otherwise uses the Website, he declares and undertakes that he is at least 18 years old. If the user is under 18, he may use the Website's services with approval by a parent/guardian and with the consent thereof to these terms of use in full.
    8. If the user is under the age of 18, and therefore does not have capacity to make the purchase, the user's guardian may request to return the product that was purchased on the Website or receive credit for the product supplied and/or the service provided to him, all in accordance with Tel Aviv Global's product return policy and the provisions of Israeli law.
  4. Privacy
    1. Tel Aviv Global shall make its best efforts, using the means available to it, to keep the details of the users of the Website confidential, and prevent their reaching foreign persons.
    2. Tel Aviv Global operates security systems appropriate for internet websites. However, it is not capable of blocking and/or preventing with certainty and absolutely any unauthorized penetration into the databases, and the user hereby waives any claim and/or suit against Tel Aviv Global in this matter, provided that Tel Aviv Global takes reasonable measures in order to prevent such penetration.
    3. When the user uses the Website, information on the pages and advertisements displayed to him, content that interested him, the duration of his stay on the Website and the activities performed on it by him shall be collected.
    4. The information collected is used by Tel Aviv Global for the purpose of delivering and supplying the purchased products to the users.
    5. In addition, Tel Aviv Global shall collect additional details, including the full name of the person ordering the service, the name of the organization (if any), and the address, email address and telephone number. Such information shall be collected through the registration forms for the tour.
    6. Furthermore, there is an option in the Website to receive updates from Tel Aviv Global regarding events that are taking place in the city. A user who is interested in signing up for the said mailing list, will fill in his full name, email address and phone number (optional) through a registration form.
    7. Tel Aviv Global may retain the information and use it for its needs, subject to the restrictions contained herein and the provisions of any law. Tel Aviv Global may use the information stored by it on the User's use of the Website, for the purpose of generating and analyzing statistical data.
    8. Tel Aviv Global may transfer the user's details to a third party, inter alia in the event that the user breaches any of the provisions hereof or of any additional agreement with Tel Aviv Global or any person acting on its behalf, and also in the event that Tel Aviv Global or a third party receives an order by a competent authority requiring it to deliver the user's details to a third party.
    9. The user must safeguard his details and ensure the confidentiality thereof. Tel Aviv Global shall not be liable for any injury caused to the user as a result of improper use of the details provided by the user.
    10. Third party components are implemented on the Website, such as Menahel4u and Go Credit. Use of the Website constitutes evidence for the user's knowledge of and consent to the use of such components by the Website.     11. Tel Aviv Global may transfer the collected information to third parties in Israel and outside of Israel, in order to support and operate the Website (inter alia through 'cloud' services). By using the website the user acknowledges his/hers consent of the transfer of such information.
    12. The user may request that Tel Aviv Global delete his details as referred to above from the databases in its possession.

  5. Infringements and remedies
    1. The contents of the Website may not be copied. Inter alia, and without derogating from the provisions of any law, the contents appearing on the Website may not be copied, reproduced, distributed, published or otherwise used, without Tel Aviv Global's prior written consent.
    2. Copying and/or publishing images and/or trademarks and/or specifications and/or video clips from and/or on the Website, without the prior written consent of Tel Aviv Global or the appropriate owner of the rights is strictly prohibited.
    3. Tel Aviv Global may operate a notification and removal procedure in any case of a suspicion of an infringement of the rights of third parties, including intellectual property rights, copyrights, trademarks and any other right, at its sole discretion.
    4. Each party shall be liable for its own acts and omissions, including in connection with the content published by it. Tel Aviv Global shall not be liable for infringements committed by third parties.
  6. Rules of conduct on the Website

    Without derogating from any other provision, the following provisions shall apply to every user:
    1. In filling out forms and entering particulars, the user is required to act fairly and to provide accurate and correct particulars and details. Without derogating from the generality of the foregoing, it is hereby clarified that the provision of false particulars and details is liable to amount to a criminal offense.
    2. Use, by users, of harmful, blatant or obscene language content, and or such that is liable to be offensive and/or slanderous and/or to constitute liable and/or defamation and/or a violation of any provision of the law, is strictly prohibited. If any user violates this clause, he shall indemnify Tel Aviv Global immediately at its first demand, including for any demand or claim directed to Tel Aviv Global by any third party.
    3. Without derogating from the foregoing, Tel Aviv Global is entitled, but not obligated, to take any legal measures available to it against users who violate the provisions of any law and/or the provisions hereof. In the event of any such violation, Tel Aviv Global may immediately remove any use and/or content and/or product from the Website, and/or deliver the user's details to any statutory authority and/or other person, and/or take any other measure required in the circumstances of the matter, at Tel Aviv Global's absolute discretion.
    4. It is hereby clarified that Tel Aviv Global may edit and/or amend and/or add to and/or delete and/or not assign weight to and/or not display at all all or part of any content item, all without it being required to give notice thereof, in advance or after the fact.
    5. Tel Aviv Global may publish all and/or part of the contents, including all or part of user feedback data, on the Website, or through any other means or media, and/or use them for any other purpose, including the advertising of the Website, and the users shall have no claim against such publication.
  7. Links
    1. If any links to internet websites that are not Tel Aviv Global's website, will appear on the website, Tel Aviv Global shall not be liable or responsible for the degree to which they are functioning properly /reliable/legal, or for their performance and/or the content that exists on them and/or the nature and quality of the services provided or products supplied on and/or through them.
    2. The user passes to such websites through the links from the Website at his own risk, and accordingly, he shall have no claim against Tel Aviv Global in connection with any damage or loss caused to him by and/or on such websites, and/or as a result of browsing to them and/or in all matters concerning accessibility to them.
    3. In addition, Tel Aviv Global does not guarantee that all the links contained in the Website function properly or are up-to-date and lead to an active internet website.
    4. Tel Aviv Global may remove from the Website links that were previously included therein, or avoid adding new links, all at its sole discretion.
  8. Use of 'cookies'
    1. Tel Aviv Global may use 'cookies', which are small text files stores on the user's computer hard drive, including in order to provide quick and efficient service to the user, and to avoid requiring him to enter his personal details each time he logs into the Website.
    2. The information provided by the user shall be used in order to adjust the content and advertisement displayed to him, and also in order to send updates and direct mail, marketing information and commercial offers that may interest him, and also for the purpose of control, segmentation, management and improvement of the users' experience on the Website.
    3. It should be emphasized that the degree of convenience in browsing the Website is liable to be affected if the user decides to reject the 'cookies' and certain functions on the Website will not operate without the use of 'cookies'.
    4. It is hereby clarified that such files do not contain any personally identifiable information, and the user can set his browser software in such a manner that 'cookies' do not accepted on the computer or are deleted.
  9. Changes in the Website, suspension of the service and technical support services
    1. Tel Aviv Global reserves the right, at its sole discretion and without notice, to suspend the availability of use of the Website from time to time, for the purpose of the maintenance and/or organization and/or updating the content on the Website and/or for any other purpose.
    2. Such changes may be by way of changing the structure or appearance of the Website or the extent and availability of the services offered thereon, and also any change in any other aspect involved in the Website and the operation thereof.
    3. Such changes may initially cause inconvenience, and be characterized by malfunctions, shut-downs etc.
    4. The users shall have no claim and/or demand and/or suit against Tel Aviv Global with respect to such performance of changes and/or malfunctions caused as a result thereof and/or suspended availability.
    5. Tel Aviv Global reserves the right to decide, at any time and at its sole discretion, to close the Website.
    6. Tel Aviv Global shall publish on the Website a notice regarding its intention to do so at least 7 days in advance before its closure. It is hereby clarified that if any authority decides to shut down the Website, for any reason, whether temporarily or permanently, Tel Aviv Global shall not be required to give notice of such shut down, and the users shall have no claim and/or demand and/or suit against Tel Aviv Global with respect to this matter.
    7. Tel Aviv Global reserves the right, at its discretion and at any time, to make changes to these terms of use, without giving prior notice thereof on the Website. Any change in these terms of use shall come into effect within 7 days from the date it is first published.
    8. Tel Aviv Global recommends that users inspect the provisions of the terms of use each time they log into the Website, in order to keep up-to-date on any changes that may have occurred in the terms of use.
    9. Tel Aviv Global does not undertake to provide technical support services, including, without limitation, services concerning the operation of the Website and/or the services provided through it. The users shall have no claim and/or demand and/or suit against Tel Aviv Global with respect to the absence of such technical support services.
  10. Liability
    1. Tel Aviv Global shall not be liable for any damage or loss caused in connection with or as a result of use of the Website, including as a result of any act and/or omission on the part of the manufacturer, producer or provider of the relevant product or service that will be sold on the Website. Tel Aviv Global shall not bear any responsibility or liability except as expressly stated herein and in accordance with the provisions of the law.
    2. The sole and exclusive remedy available to the user in the event of a fundamental breach in the provision of any services ordered via the Website shall be the cancellation thereof, and the user shall have no further claims against the supplier or service provider or Tel Aviv Global.
    3. In the event of an unusual and obviously apparent typing error in the description of any service, e.g., a price stated in agorot instead of in NIS, the erroneous description shall not be binding upon Tel Aviv Global.
    4. Without derogating from the generality of the foregoing, the service on the Website is provided without any representation or implied warranty, and the user or the person preforming the relevant act shall have no claim and/or demand and/or suit of any kind against Tel Aviv Global with respect to the features, characteristics, restrictions or limitations of the service, or its fitness to the purposes and requirements thereof.
    5. Liability for the product shall be effective only with respect to a customer who possess an original proof of purchase and only if the purchase was made via the store on Tel Aviv Global's sales website.
    6. Tel Aviv Global reserves the right to demand that the customer prove that he is the original purchaser of the product.
    7. The sole remedy for any defective product covered by the warranty shall be the repair of replacement thereof.
    8. The total liability of Tel Aviv Global with respect to any defective product shall not exceed, in any case, the purchase price thereof.
    9. Tel Aviv Global shall not be liable for any damage or loss that is and/or may be caused in the delivery of the products, if the delivery is performed by the Israeli Post, and if it is performed by a private courier company.
    10. In the case of product ordered abroad, taxes, levies or other payments may be applicable in the country to which the product is delivered. Such payments shall be payable only by the person ordering the product, and be added to the price thereof, all in accordance with the laws existing in the country to which the product is delivered.
    11. Tel Aviv Global shall not be liable for any direct or indirect damage or loss arising from the use or improper use of the product, including any accidental, special indirect or consequential damage or loss – if the law allows it. The customer shall be solely responsible and liable for any loss, damage or injury cause to his body and/or property and/or the body or property of third parties, arising from use and/or non-use of the product, and such use or non-use shall be solely at his risk, shall bear the risk except in cases where it is determined that such damage or loss was caused as a result of negligence on the part of Tel Aviv Global.
    12. Tel Aviv Global shall not be liable for any direct or indirect damage or loss arising from the customer's participation in an Event (as defined in section 16.2 below), including any accidental, special indirect or consequential damage or loss to the extent that the law allows it. The customer shall be solely responsible and liable for any loss, damage or injury cause to his body and/or property and/or the body or property of third parties, arising from the customer's participation in an Event (as defined in section 16.2 below), and such participation shall be solely at his risk, except in cases where it is determined that such damage or loss was caused as a result of negligence on the part of Tel Aviv Global.
  11. Security
    1. Tel Aviv Global secures the Website by means of an SSL protocol for secure online communication. Tel Aviv Global's website meets the most stringent security standards, so that all the information provided by our customers while browsing and making purchases on the Website remains confidential and secured.
    2. An SSL Web Server digital certificate is installed in the server, and allows information to be transferred securely.
    3. The digital certificate installed in the sever performs the following:
      1. verifies that the server to which you are connected is actually the correct server;
      2. creates a secured communication channel, by encrypting all the information transferred between the web browser and the server;
      3. performs a test to insure that the information sent from the personal computer arrives at the Website in full, without errors and without disruptions.
    4. Tel Aviv Global undertakes not to deliver the payment details (the details of the credit card or other means of payment approved by Tel Aviv Global) of the customer to any person except the applicable credit company/clearing company approved by Tel Aviv Global.
    5. Tel Aviv Global implements advanced protection mechanism, in order to secure the information on the Website. Any penetration to the computer systems of the Website or Tel Aviv Global constitutes a criminal offence under applicable law. It is hereby clarified that despite the advanced security mechanisms employed by Tel Aviv Global, as the transactions and activities are performed in an online environment, Tel Aviv Global cannot guarantee absolute immunity from penetration into its computers, attempts at such penetrations, exposure of information and/or disruptions to and/or interruptions in the operation of the computer systems serving the Website. Therefore, if the user transfers any information through the Website, he does so solely at his own risk, and he shall have no claim and/or demand and/or suit against Tel Aviv Global in the event of exposure of such information to unauthorized persons.
    6. The details of the credit cards of the customers effecting transactions on the Website are not retained in Tel Aviv Global's systems at all. The clearing of such transactions is performed in a secure manner by Go Credit, who is qualified for the PCI standard.
    7. If the user uses the Website and the various services, the contents uploaded to the Website and any related content, he does so solely at his own risk. Tel Aviv Global recommends that users install protection software and adequate means of security, before any use of the Website and its services.
  12. Making purchases on the Website
    1. The Website allows customers to buy products online conveniently, easily and safely.
    2. The products that are sold by Tel Aviv Global can be purchased on the Website at any time, until it is out of stock.
    3. Purchasing online is done only by the means of payment specified above.
    4. Tel Aviv Global reserves the right to terminate the marketing and sale of its products at any time, and also to rescind the right to purchase on the Website and/or on any external sales website, at its discretion.
    5. Making purchases through the Website is subject to the conditions set out herein.
    6. The purchasing of the product constitutes a declaration by the customer that he read, understood and accepts the provision hereof.
    7. These terms of use constitute a binding contract between the user and Tel Aviv Global.
  13. Receipt of the services
    1. In order to receive some of the services offered on the Website, the user is required to register in the system in a one-time manner, or to identify himself by various means. As part of registration process, the process of identity verification is performed, through the provision of various details (hereinafter: “the Identification Details"), which are validated by matching them with the information contained in business databases.
    2. The provision of the Identification Details and contact details constitutes a condition for obtaining the services through the Website. If a user who does not wish to provide the Identification Details or contact details, or provides Identification Details which do not match the information contained in the relevant databases, he shall not be able to receive the online service through the Website, and shall be required to contact the service provider in order to obtain it.
    3. Tel Aviv Global shall not be liable in any case of disclosure of information or grant permission to effect transactions or perform other acts to another person who identifies himself by means of the user's payment details, or registers in the user's name.
    4. For the avoidance of any doubt, it should be clarified that use of the identification system for the purpose of obtaining identified services is personal, and use of identified services by any other person in the name of the user, constitutes a breach of these terms of use, and may be treated, in certain circumstance, as a criminal offence.
  14. Returns and cancellations
    1. The cancellation of a transaction by a user shall be made not later than 2 business days before the date of the tour or the purchase. The customer's money shall be refunded, for the returned product only, within 14 days from the date of receipt of the cancellation notice.
    2. The cancellation of a transaction shall be made in accordance with the Consumer Protection (Cancellation of a Transaction) Regulations, 5771-2010, and the Consumer Protection Law, 5741-1981.
    3. Notice of cancellation of a transaction shall be delivered to Tel Aviv Global in one of the following ways:
      1. via telephone: 03-5166188;
      2. via email: tourism@tel-aviv.gov.il;
      3. via the chat bot on the Website.
    4. The cancellation of the transaction shall only become effective on receipt of an email message from Tel Aviv Global confirming the request for cancellation of the transaction. In the event of cancellation of a transaction, Tel Aviv Global shall refund the money to the customer, less the cancellation fee referred to above.
    5. The transaction cancellation policy set out above shall only be applicable to the products purchased on the Website. Tel Aviv Global shall not handle returns of products purchased through any other source.
  15. Customer service

  16. Liability and service
    1. The liability of the products that are sold by Tel Aviv Global covers material defects in the body and/or operation of the product, caused by Tel Aviv Global.
    2. As for liability for a product of the “various products" type, see clause 14.6 above.
    3. Liability for a product of the lectures, guided tours, etc. (hereinafter: “Event"), is as follows:
      1. tickets purchased on the Website may not be replaced for tickets for a different Event, except with Tel Aviv Global's consent;
      2. the customer shall be required to enter full and available details, for obtaining information on the event for which the tickets are ordered (e.g., cancellation or change);
      3. if incorrect contact details are provided, the customer shall be solely liable for the consequences thereof;
      4. if notification of a change in the date of an Event for which tickets were ordered is sent, the credit cards of any purchasers who notify Tel Aviv Global of their inability to participate in the tour shall be credited, one week after the date of such notification;
      5. in the event of any force majeure – event independent of the non-profit association, e.g., illness of the guide, war, a military operation, any disaster, etc. – where Tel Aviv Global is forced to postpone the tour, the purchaser shall be responsible for obtaining a refund or changing the tickets not later than 7 business days before the date to which the tour is postponed;
      6. any request exceeding the periods prescribed by law shall be considered by Tel Aviv Global on an case-to-case basis and at its sole discretion;
      7. the purchaser must present the electronic ticket received by him by email on the date of the purchase, or alternatively, an identifying card by means of which the order was placed;
      8. product return policy – the cancellation shall be made within 14 days from the date on which the transaction is effected and from the date of the performance/event; in accordance with section 14C of the Consumer Protection Law (“Remote Sale Transaction"), if the cancellation is made within the 7 days, which are not days of rest, preceding the event, the purchaser shall not receive any refund;
      9. if the customer does not participate in the event no refund shall be made;
      10. for the avoidance of any doubt, Tel Aviv Global provides events of various kinds, and presents a variety of different content;
      11. the user shall have no claim and/or suit against Tel Aviv Global, and in addition, any cancellations or refunds shall be made subject to Israeli law.
    4. Products ordered especially for the customer, such as special guests, special Events, etc., may not be cancelled.
    5. The user undertakes not to commit any act which constitutes unlawful penetration of the computers of Tel Aviv Global and/or the Website, scan for access routes and/or loopholes in such computer systems, hack the security and/or encryption systems protecting the Website and the information contained therein, or aid in the commission of such acts.
  17. Intellectual property
    1. All the intellectual property rights in the Website, including, without limitation, copyrights, trademarks, trade secrets, and the organization and ordering of the content thereon are the exclusive property of Tel Aviv Global  or of third parties from whom Tel Aviv Global duly received a license, and they are protected by the laws of the State of Israel and international conventions. Such intellectual property rights are applicable, inter alia, to the Website's graphic design, the databases contained therein, its computer code and any other item relating to the operation thereof.
    2. No content existing on the Website may be copied, reproduced, distributed, sold, marketed or translated, except with Tel Aviv Global's prior written express consent, and subject to the conditions for such consent (if given).
    3. The Website may not be presented with a design or graphic interface different from those designed for it by Tel Aviv Global, except with Tel Aviv Global's prior written express consent, and subject to the conditions for such consent (if given).
    4. The name “Visit TLV", Tel Aviv Global's (registered or unregistered) trademarks, and also the Website's domain name (visit-tlv.co.il), are all the exclusive property of Tel Aviv Global, and may not be used, except with Tel Aviv Global's prior written consent, and subject to the conditions for such consent (if given).
    5. No commercial use may be made of the Website and/or the information published thereon and/or the database thereof and/or any other details published thereon, without the prior written consent of Tel Aviv Global.

       
  18. Prescription
    1. Notwithstanding anything stated in any law, the prescription period for an action against Tel Aviv Global and/or any person acting on its behalf, with respect to use of the Website and/or any other act done on the Website (including the purchase of tender documents) shall be 12 months from the date of accrual of the claim or its underlying cause of action.
    2. The user declares that he agrees to the stipulation contained in this clause, notwithstanding anything prescribed by law.
  19. Indemnification

    The user undertakes to indemnify Tel Aviv Global and/or any other person and/or body acting on its behalf for any damage and/or loss and/or expense and/or cost incurred by or imposed upon them, including legal fees and/or other legal costs and expenses, as a result of a breach of (all or part of) these terms of use, and/or any infringement or violation of any third party rights.
  20. Accessibility
    1. In order to make this Website accessible for persons with disabilities, this Website was constructed in accordance with the Web Content Accessibility Guidelines (WCAG) 2.0.
    2. Notwithstanding the foregoing and Tel Aviv Global's efforts to make all the elements of this Website accessible, it may be discovered that parts of this Website are not yet accessible.
